Kasus itu berawal ketika dirinya merekam percakapan telefon dari Kepala Sekolah SMAN 7 Mataram yang bernama Muslim. Dalam percakapan tersebut, Muslim diduga melecehkan Nuril secara verbal. Rekaman percakapan antara keduanya kemudian tersebar dan membuat Muslim melaporkan Nuril ke polisi atas tuduhan menyebarkan konten bermuatan asusila.
Sebelumnya, Majelis hakim Pengadilan Negeri Kota Mataram membebaskan Nuril dari sangkaan, namun jaksa penuntut umum mengajukan kasasi ke MA atas putusan ini dan MA kemudian memvonis Nuril. Keputusan Hakim MA Sri Murwahyuni itu dinilai tidak adil oleh sejumlah pihak.
Berikut ini fakta-fakta soal kasus Nuril sebagaimana telah dirangkum�Okezone:
1. Dijerat UU ITE
Mahkamah Agung (MA) dalam putusan kasasinya menyatakan Baiq Nuril Maknun bersalah atas sangkaan mendistribusikan atau mentransmisikan konten kesusilaan seperti termaktub dalam pasal 27 ayat 1 Undang-Undang Informasi dan Transaksi Elektronik (ITE). MA menjatuhkan hukuman enam bulan penjara dan denda Rp500 juta kepada Nuril.
Padahal sebelumnya mantan pegawai honorer bagian Tata Usaha di SMU 7 Mataram itu dinyatakan bebas di Pengadilan Negeri Mataram pada 26 Juli 2017. Nuril dinyatakan tidak terbukti telah mencemarkan nama baik mantan Kepala SMAN 7 bernama Muslim.
2. PBNU Nilai Upaya Baiq Nuril Bukan Pidana
Tanpa bermaksud menilai putusan Mahkamah Agung (MA), putusan yang menghukum bersalah melanggar UU ITE terhadap Baiq Nuril Makmun sangat disesalkan. Karena dinilai melukai rasa keadilan hukum yang hidup dan berkembang di masyarakat (living law). Hal tersebut dinyatakan Ketua�PBNU�bidang hukum, HAM, dan perundang-undangan, Robikin Emhas, dalam keterangannya yang diterima Okezone, Sabtu (17/11/2018).
Sewaktu menjadi guru honorer di SMA 7 Mataram tahun 2017 lalu, Baiq Nuril sering ditelpon M, kepala sekolah saat itu. M menceritakan pengalamannya berhubungan seksual dengan perempuan bukan istrinya. Guna melindungi diri dari kemungkinan tuduhan selingkuh dari suaminya dan pelecehan seksual lebih lanjut, Baiq Nuril Makmun lalu merekam pembicaraan tersebut. Rekaman suara tersebut lalu tersebar. Menurut Baiq Nuril hal itu di luar dirinya.
"Perlu ditegaskan, perbuatan M menceritakan pengalamannya berhubungan seksual dengan perempuan bukan istrinya kepada Baiq Nuril tersebut secara hukum patut dikualifikasi sebagai pelecehan seksual terhadap diri Baiq Nuril," ujar Robikin.
3. MA Persilahkan Baiq Nuril Ajukan PK
Masyarakat MA, Abdullah, mengatakan PK merupakan hak asasi warga untuk mendapatkan keadilan. Karena itu, pihaknya tidak akan membatasi upaya dari pihak Nuril tersebut. "Masalah PK itu kan hak asasi warga negara untuk mendapat keadilan. Apabila nanti terdakwa atau terpidana mengajukan PK ya silakan saja," ujar Abdullah saat ditemui di Gedung MA, Jakarta Pusat, Jumat (16/11/2018).
MA, kata dia, tidak mempunyai alasan untuk membatasi upaya hukum lanjutan yang dilakukan pihak Nuril. Asalkan upaya hukum tersebut dilakukan sesuai aturan perundang-undangan yang berlaku. "Tak ada alasan untuk membatasi upaya hukum luar biasa (PK)," imbuh Abdullah.
4. Nasib Anak Baiq Nuril
Korban kekerasan seksual Baiq Nuril Manun harus menelan kekecewaan karena dirinya malah terancam penjara. Mahkamah Agung telah menjatuhkan pidana bagi ibu dari 3 orang anak tersebut.
Menyikapi kasus hukum ini, Psikolog Meity Arianty, coba melihat sisi lain, yaitu sisi psikologis. "Saya tidak dapat membayangkan bagaimana sedihnya keluarga Nuril, bagaimana suaminya yang pasti merasa shock, malu, sedih, kecewa, bahkan mungkin marah mendengar kabar tersebut," ungkap Psikolog Mei pada Okezone melalui pesan WhatsApp, Jumat (16/11/2018).
Psikolog Mei sadar betul bahwa kabar ini tentu membuat hati banyak orang kecewa. "Mendengar istrinya dilecehkan saja pasti sudah sangat berat, apalagi sekarang harus menerima kenyataan Nuril menjadi tersangka," sambungnya.
Bahkan, menurut Psikolog Mei, tidak sampai di situ saja. Hal yang paling menyedihkan adalah anak Nuril yang dikabarkan tidak mau bersekolah karena adanya kasus ini.
"Mereka merasa malu, tentu juga sedih. Mau marah, marah sama siapa? Dapat dibayangkan bagaimana keluarga Nuril harus menanggung rasa malu dan kesedihan itu," paparnya.
5. Ironi Hukum di Indonesia
Baiq Nuril mendapat pelecehan Kepala Sekolah SMAN 7 Mataram, Muslim. Kasus itu berawal di tahun 2017 saat itu Muslim yang menelepon dirinya menceritakan pengalaman hubungan seksualnya dengan perempuan lain. Nuril kemudian merekam pembicaraannya untuk membuktikan dirinya tak memiliki hubungan dengan Muslim. Rekaman tersebut tersebar namun alih-alih mendapat keadilan Nuril justru dijatuhi vonis MA.
